The Federal-Mogul Asbestos Personal Injury Trust was formed to “provide fair, equitable, and substantially similar treatment for all Asbestos Trust Claims…” It was established in 2007 when $2.1 billion was set aside by Federal-Mogul for victims of asbestos-related disease whose diagnosis was at least in part caused by being exposed to Federal-Mogul products that contained asbestos. The Federal-Mogul asbestos trust’s purpose is to process, liquidate, and pay viable claimants.
Federal-Mogul manufactured and designed powertrain equipment, including engine bearings, pistons, and metal parts.
To receive payment, there are different types of review processes for claims that are filed. There is either an Expedited Review or an Individual Review process. The purpose of an Expedited Review is to provide a fast, efficient and cheaper way of liquidating claims. The intention of this review process is to give claimants a fixed liquidated claim value. When it comes to an Individual Review the purpose is to provide those filing claims with an individual consideration of their claim.
The Federal-Mogul asbestos trust categorizes different diseases into different Disease Levels, which then determines the scheduled payment amount. The diseases that are categorized include mesothelioma, lung cancer 1, lung cancer 2, other cancer, several asbestosis, asbestosis/pleural disease, and other asbestos disease.
Mesothelioma is classified as a Level VIII disease level. To meet the criteria for the payment for this disease level the claimant must be diagnosed with mesothelioma and must have exposure to Federal-Mogul asbestos-containing products.
A Level VII disease level, lung cancer 1 claimants must have a diagnosis of a primary lung cancer along with evidence of an underlying bilateral asbestos-related nonmalignant disease, six months Federal-Mogul Exposure to asbestos before December 31, 1982, “Significant Occupational Exposure”, and medical documentation supporting their lung cancer diagnosis is correlated to asbestos exposure.
Lung Cancer 2 is categorized as a Level VI disease. To meet the criteria for payment claimants must have a diagnosis of a primary lung cancer, exposure to Federal-Mogul asbestos-containing products prior to December 31, 1982, and supporting medical documents correlating the lung cancer diagnosis to asbestos exposure.
“Other Cancer” is a Level V disease level. Claimants must have a diagnosis of a primary esophageal, colo-rectal, pharyngeal, or stomach cancer along with evidence of an underlying bilateral asbestos-related nonmalignant disease. They must also have six months exposure to Federal-Mogul asbestos-containing products prior to December 31, 1982, Significant Occupational Exposure, and supporting medical documents.
This is a Level IV disease which needs a diagnosis of asbestosis through pathological evidence of asbestos, six months exposure to Federal-Mogul asbestos-containing products prior to December 31, 1982, and supporting medical documentation.
To qualify for the payment for this disease level, claimants must have a diagnosis of a bilateral asbestos-related nonmalignant disease, six months exposure to the asbestos products before December 31, 1982, and supporting medical documents.
Claimants must have a diagnosis of a bilateral asbestos-related nonmalignant disease, the same six-month exposure criteria, and five years of cumulative asbestos exposure.
This is classified as a Level I disease. To meet the criteria for payment there must be a diagnosis of a bilateral asbestos-related nonmalignant disease or an asbestos-related cancer that is not mesothelioma, and six months exposure to Federal-Mogul asbestos products before December 31, 1982.
